Louth man takes GAA to court

A Louth GAA supporter is bringing the association to court over that now 'infamous' goal.

The 2010 Leinster final ended in farce when Meath won the title after they scored an injury time goal that should have been clearly disallowed when Meath forward Joe Sheridan threw the ball to the net.

Despite, pleas from the Louth County Board that the match be rescheduled, Croke Park chiefs insisted that the matter was out of their hands.

However, Louth supporter Paddy Garvey is taking the case against the GAA and there will be a hearing at the Four Courts on December 13th.

Mr Garvey had attempted to summon GAA President Christy Cooney in July, but the move was dismissed by a Dublin District Court.

The Louth supporter claims that the GAA 'deliberately' broke its own rules of play by letting the result stand as the Wee County missed out on winning their first Leinster title in 50 years.

If, by an extraordinary outcome, Mr Garvey is successful, this could have serious repercussions for the GAA as it will leave the door open for future decisions to be contested in court.

The end of sport as we know it in Ireland if this is successful. Cant see it myself but you never know.

Would every single wrong decision made on the field of play then be subjected to legal claims from supporters?

Think of all the injustices in all sports accross the world over the years. Imagine if all of of those were subjected to court room battles to over turn results, strip teams of titles, re-instate teams in competitions etc. Mad mad mad mad.

Yeah but at the same time Sam there is more injustices in GAA than in any other sport.
There are more rules in GAA that are implemented in such an inconsistent manner week in/week out. It's a case of 1 rule for some and another rule for others.

Imagine the above had happened to Dublin in this years All Ireland final? I am not clairvoyant but I bet the result would not have stood.

I too, would be amazed if this was successful, but ..

he's obviously going in with a very very strong case or he's a bit touched?

does he not realise he will incur all of the legal costs if (inevitably) he loses this case?

Don't agree with this in principle but if it succeeds in scaring the gaa into getting big calls right, and by that I mean assisting officials with technology etc to do this then great.

If, and it's a big if, this lad is successful then what exactly will the GAA have to do? Will it have to grant a replay of the Leinster Final, and thus all matches thereafter would need to replayed too if there was a change in the result?

Imagine how big a can of worms this thing could open up. Every match decided by or influenced by a wrong decision could see fans taking the GAA to court.

I'd be very interested to know what solicitor or firm, if any are taking this case on and representing him.

Also wonder if he's this bitter still about it all, could he have been one of the fans seen on the pitch attempting to have a go at Sludden after the final whistle?

jesus Kildare would have some amount of games to replay if that was the case!!

This would all render Dublins All-iRELAND victory null and void as all records from games after the Louth/Meath one would have to be wiped ;-)

Silly season has just moved on to another level.

What would the Gaa do ??? They would ignore it, there was a High Court decision against them regarding the parish rule during the summer. The sent it back to the county concerned and the original decision was up held, a clear show of contempt for the courts, was anybody jailed??? No that just happens to little old ladies from Offaly, today's supreme court ruling showed, money WILL buy u out of most things

GAA stands over procedures

The GAA insists it followed correct procedures in the wake of last year's controversial Leinster football final when Louth were denied a first provincial title in 53 years by a shocking refereeing decision.

Louth fan Paddy Garvey from Mornington - which is just outside Drogheda but is actually in Co. Meath - is taking the GAA to the High Court on December 13 amid claims that the Association "deliberately" broke its own rules when it "declared" Meath winners after Joe Sheridan's last-gasp illegal goal was allowed to stand.

But speaking to the Irish Examiner, GAA Operations Manager Feargal McGill was confident that the Association followed correct procedures and didn't break its own rules by awarding the Leinster title to Meath.

"The GAA are absolutely confident that we followed the rule books very carefully at the time and that we followed our rules to the letter of the law," he said..

"That was to the dissatisfaction to a lot of people at the time, who felt we should have went a different way. The very fact that no replay was ordered and the score stood was because we followed the GAA rule book to the exact letter. To have done anything else would have opened us up to litigation."
